This reality brings responsibility towards the quality of the air and the
quality of the water. To neglect
legionella
can generate pollution in both
these resources.
As defined in the paragraph III, of the article 3, of the Law nr. 6.938/81,
pollution is the “degradation of the environmental quality resulting from
activities that either directly or indirectly: a) cause harm to health, safety
and well-being of the population (…) d) affect the sanitary (…) conditions
of the environment”.
And this pollutionmay be considered as environmental crime, pursuant
the article 54 of the Law 9605/98:
Art. 54. Causing pollution of any nature, at levels which may cause or be
capable of causing harm to human health, or which may cause death of animals
or significant destruction of plant life.
Sanction – imprisonment for one to four years, and a fine.
§ 1 If the offense is attributable to negligence:
Sanction – imprisonment for six months to one year, and a fine.
§ 2 If an offense were to:
I – render an urban or rural area unfit for human occupation;
II – cause atmospheric pollution which may result in removal of inhabitants
from contaminated areas, even on a temporary basis, or if harm to the health of
the population were to be caused;
III – cause water pollution which creates a need for interruption of public
supplying of water to a community;
IV – hinder or prevent public use of beaches;
V – occur on account of disposal of solid, liquid, or gaseous water, or debris,
oil or oily substances, without compliance with requirements defined by laws or
regulations:
Sanction – imprisonment for one to five years.
§ 3 The same sanctions which are indicated in the preceding paragraph shall
be applicable to persons who fail to adopt precautionary measures in the event or
