By their turn, administrative infringements are regulated by Federal
Law 6.437/77 and sanitary codes (state and municipal), as aforementioned.
Civil liability is ruled by the general rules contained in the Brazilian
Civil Code and, as it also corresponds to diffuse rights, by the Public Civil
Action Law. The indemnification comprises material and moral damage,
emerging damage, and loss of profit.
With this brief and plain study, which does not comprise all the possible
aspects of a deepened analysis on the subject, the main parameter for a first
thinking on the theme significance are provided, and this theme can be
analyzed under several scopes (preventive and repressive) and several Law
branches (Constitutional, Environmental, Sanitary, Civil, Administrative,
Consumer, Penal, among others).
